THE MARRIAGE OF JOHN & ELIZABETH CROMBLEHOLME

INFORMATION FROM WILLS:

 

John Crombleholme:
12 May. The Will with two Codicils of John Crombleholme, late of Kirkland in the County of Lancaster, Innkeeper, who died 27 December 1872 at Kirkland was Proved at Lancaster by Joseph Rooking of Garstang in the said county, Superintendent Registrar, and Elizabeth Crombleholme of Kirkland, Widow, the Relict, the Executors.

This is the last will and testament of me John Crombleholme of Kirkland in the county of Lancaster, Innkeeper whereof I do nominate, constitute and appoint Joseph Rooking of Garstang in the said county, Clerk, and my wife Elizabeth Crombleholme Executors.

I give devise and bequeath unto my said Executors the whole of my personal estate whereof I may be possessed at the time of my decease subject to my debts, funeral and testamentary expenses, upon trust as soon as convenient after my decease to pay to the Officiating Priest of the Roman Catholic Church in Barnacre with Bonds in the said county the sum of one hundred pounds and upon trust to permit my said wife to use and carry on the business which I hold at the time of my decease during her will and pleasure with the use of all my household goods, plate, linen and china, glasses, spirits, and other effects their used in the business and to lay out upon security all money not wanted in the business and to pay the interest thereof to my said wife during her life and in case my said wife shall elect to retire from the business of an Innkeeper then that she be permitted to take any part of the furniture to fit up a cottage for her own comfort and I direct that the remainder shall be sold and made into money and the proceeds thereof invested and the interest thereof paid to my said wife during her lifetime as aforesaid. And after the decease of my said wife then I direct the said Joseph Rooking, his executors, administrators or assigns to receive recover and get in all monies and other effects and to pay the same as follows, that is to say, one half part thereof to the children of my Brother in Law Joseph Weights and Samuel Weights in equal proportions when and as they arrive at the age of Twenty one years. As to the other half thereof I direct that the sum of Fifty pounds thereof be paid to Margaret, the daughter of my brother Joseph Gornall and the sum of Thirty pounds to my my (sic) sister Grace, the wife of Joseph Gornall, and the sum of Thirty pounds thereof to my sister Betty and the remainder thereof amongst the children of my brothers and sisters share and share alike. And I direct that in the case of females that the share or shares of such females be paid to them for their own sole and separate use and free and clear from the debts and control of their husbands. And I declare that neither of my said Executors shall be answerable for the other of them or for any Banker, Broker or other agent or for any money which he or she shall not actually receive or for any involuntary loss and that each trustee may retain and allow to the other of them out of any monies which may come to his or her hands all expenses to be incurred in the execution of this Will and the trusts thereof.

This is a Codicil to my last Will and Testament bearing date the Tenth day of October One thousand eight hundred and sixty two which I direct shall be annexed and deemed part thereof. Whereas by my said Will I have given unto Margaret, the daughter of my brother Joseph Gornall the sum of Fifty pounds Now I do hereby revoke the said legacy and in lieu thereof do give and bequeath unto my nieces Margaret and Mary, the daughters of my said brother Joseph Gornall the sum of nineteen pounds each and to my niece Jane, the daughter of my said brother Joseph Gornall, the sum of twelve pounds and in all other respects I confirm my said Will.

Signed, acknowledged, published and declared by the said Testator John Crombleholme as and for a Codicil to his last Will and Testament in the sight and presence of us who at the same time at his request in his sight and presence and in the sight and presence of each other have hereunto subscribed our names as witnesses. This Codicil being first read over to the said Testator who properly understood the same.

This is a Codicil to my last Will and Testament bearing the date the Tenth day of October One thousand eight hundred and sixty two which I direct shall be annexed to and deemed part thereof. Whereas by my said Will I have given unto my Executors therein named the whole of my personal estate whereof I may be possessed at the time of my decease subject to my debts, funeral and testamentary expenses. Upon trust as soon as convenient after my decease to pay the Officiating Priest of the Roman Catholic Church in Barnacre with Bonds in the county of Lancaster the sum of one hundred pounds, Now I do hereby revoke the said legacy of one hundred pounds and in lieu thereof do give and bequeath the sum of one hundred pounds to the officiating Priest of the said Church and do direct that the same shall be paid as soon as convenient after the decease of my wife Elizabeth and in other respects I confirm my said Will and the Codicil thereto bearing the date the Thirteenth day of January

Proved at Lancaster with two Codicils the Twelfth day of May 1873 by the Oaths of Joseph Rooking and Elizabeth Crombleholme, Widow, Relict of the deceased, the Executors named in the Will to whom administration was granted.

The Testator John Crombleholme was late of Kirkland in the county of Lancaster, Innkeeper, and died on the Twenty seventh day of December 1872 at Kirkland aforesaid.

Elizabeth Crombleholme:
Elizabeth Crombleholme of Preston, Lancashire, widow, died 5 July 1892. Probate Lancaster 8 August to Joseph Weights, gentleman.

This is the last Will and Testament of me Elizabeth Crombleholme of Kirkland near Garstang in the County of Lancaster, Widow.

I direct the payment of my funeral and testamentary expenses and debts and subject thereto I give devise and bequeath and also in exercise and execution of every power in anywise enabling me in this behalf do direct limit and appoint all my real and personal estate whatsoever and wheresoever and of what nature or kind soever the same may be unto and to the use of my brother Joseph Weights of Preston in the said county according to the nature and quality thereof without any trust or condition whatsoever and I appoint my said brother Joseph Weights to be the sole Executor of this my Will.

In witness whereof I have hereunto set my hand this Twenty first day of June One thousand eight hundred and ninety.

Signed and declared by the said Testatrix Elizabeth Crombleholme as and for her last Will and Testament in the presence of us present at the same time who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses the said Will having been first read over to the said Elizabeth Crombleholme who seemed perfectly to understand the same and made her mark thereto in our presence.

On the eighth August 1892 probate of this Will was granted to Joseph Weights, the sole Executor.
