THE FAMILY OF WILLIAM & MARY HAYES

INFORMATION FROM WILLS:

 

MARY:
Mary Hayes (nee' Swarbrick) made a Will but it was apparently never Probated. The only evidence I have of her Will is a copy of a letter from her solicitor to her niece Henrietta Swarbrick:

Dear Madam,

Re: Mrs Hayes, Decd

I have been reading the Will of this deceased to-day and I thought you would like to know how the Will affected you. Your aunt has directed that all her dresses, wearing apparel & others shall be divided between yourself and your sisters Margaret & Mary.
Mr Hayes has the income of all the property of your aunt during his life - after his decease - the property has to be divided into equal parts. One part has to be invested & income paid to your sister Mary - after her death to her issue. If no issue then to such of the children of your father (including yourself) and your uncle and aunt as shall be living at Mr. Hayes decease.
The other half is given to such of the children of your father (but not your sister Mary but including you and your uncle and aunt as may be living on the death of Mr. Hayes.
When you are in Preston some time I will read you the Will.
Of course you do not receive any benefit at present save for what you take in the division of the clothes.

WILLIAM:
William Hayes, of 12 Bank-Parade, Preston, wrote his Will on 5 February 1895 appointing Yates William Booth, patent agent; William Hayes, candle manufacturer; and John France, wine and spirit merchant; all of Preston, to be the executors and trustees of his estate, and left them £15 each.

He left £150 to his housekeeper Mary Swarbrick, £200 to his priest at St. Wilfrid's Church, and £200 to his late wife's niece Mary Parker.

The rest of his estate, after paying his debts, funeral and testamentary expenses, was to be held in trust for his four sisters, Margaret Pennington, Ellen Hothersall, Mary Battersby, and Elizabeth Hothersall.

Probate was granted on 8 April 1896 to Yates William Booth, William Hayes, and John France, at Lancaster. Effects: £2198 7s 4d.
