12 January (1881) The Will of William Swarbrick late of Myerscough Mill near Garstang in the County of Lancaster Farmer and Miller who died 10 November 1880 at Myerscough Mill was proved at Lancaster by Jane Swarbrick of Myerscough Mill Spinster the Daughter and George Swarbrick of Garstang in the said County Corn Miller and Thomas Swarbrick of 30 East-view Preston in the said County Bookkeeper the Sons the Executors
 
This is the last Will and Testament of me - William Swarbrick of Myerscough Mill in the township of Myerscough in the County of Lancaster Farmer and Miller
I give all my messuages buildings lands and hereditaments and also all my real estate whatsoever and wheresoever and to which I am entitled in possession or reversion or otherwise and also all my personal estate and which respectively I now have or shall have at the time of my decease power to dispose of by this my will unto my daughter Jane and my son George as also my son Thomas their heirs executors administrators and assigns according to the nature of and during all my estate and interest therein respectively Upon trust to sell my said messuages lands and hereditaments and real estate and so much of my personal estate as shall be of a saleable nature together or in parcels or by public auction or private contract or by both of those means and to collect and get in the rest of my personal estate And I declare that the receipt or receipts of my said trustees or the trustee for the time being for the purchase and other monies coming to their or his hands in execution of the trusts herein contained shall be a good and sufficient discharge or good and sufficient discharges to the purchaser or purchasers or other the person or persons paying the same and that such purchaser or purchasers person or persons taking such receipt or receipts shall not be answerable for any loss misapplication or nonapplication of all or any of the monies so to be paid my will is that my said trustees or the trustee for the time being do and shall in the first place pay all my just debts funeral and testamentary expenses and that they carry on the business 12 months after my decease and at the expiration of 12 months after my decease my will is that all my estate both real and personal shall be sold as aforesaid and divided in the following manner
My daughters Jane and Elizabeth and my son James £200 each and my sons John George and Thomas £100 each my son William's three children to have £20 each invested in the Preston Savings Bank until they respectively attain the age of 21 years but should any of them die before they attain the age of 21 years it shall belong to the survivor or survivors of the three but should they all three die then the money shall be equally divided amongst my lawful children or their heirs and should there be any surplus after the above legacies have been paid it shall be equally divided amongst my sons John George Thomas and James and my daughters Jane and Elizabeth or their heirs but my son John has had money and goods amounting to £13 10 which must be deducted from his portion when the estate is divided my son Robert I leave the remainder of my term in the Mill according to lease which I consider a fair portion for him and I appoint my above named daughter Jane and my sons George and Thomas executors of this my will.

Signed sealed published and declared by the said William Swarbrick the testator as and for his last will and testament in the presence of us present at the same time who at his request in his presence and in the presence of each other have hereto subscribed our names as witnesses, the above will having been first read over to him which he understood.

the oaths of Jane Swarbrick Spinster daughter of the deceased
George Swarbrick and Thomas Swarbrick sons of the
deceased the executors named in the will to whom administration was granted

The Testator William Swarbrick was late of Myerscough Mill near Garstang
in the County of Lancaster Farmer and Miller and died on the tenth day of
November 1880 at Myerscough Mill aforesaid.
